BITSTORE CARD TERMS OF USE
Introduction
Please read these Terms of Use carefully. By applying for, accepting, or using the Bitstore Card, you confirm that you have read, understood, and agreed to be bound by this Agreement.
This Agreement sets forth the terms and conditions under which the Bitstore Card has been issued to you, including any amendments we may make at any time.
Your Bitstore Card account and Bitstore Card, a Visa debit card, are issued to you by Wallester AS, authorized by the Estonian Financial Supervision and Resolution Authority (Finantsinspektsioon) and an official Visa Principal Member.
For the purposes of this Agreement, Wallester AS and Digital Assets d.o.o. are collectively referred to as "we," "us," or "our." All Bitstore Card applicants and Cardholders are referred to as "you" or "your." Together, we and you may be referred to as the "Parties."
1. Definitions and Interpretation
1.1 Definitions
Agreement: These Bitstore Card Terms of Use include the Fee Schedule, Privacy Policy, Anti-Money Laundering and Counter-Terrorism Financing Policy, and any other rules or guidelines published on www.bitstore.net.
Wallester: Wallester AS (registration number 11812882), the card issuer and principal member of Visa authorized to provide payment services and the issuer of the Bitstore Card, with a registered office at F.R. Kreutzwaldi 4, 10120 Tallinn, Estonia.
Partner: Digital Assets d.o.o. (registration number 060297216), a virtual currency exchange and deposit operator with a registered office at Hrv. mornarice 1C, 21000 Split, Croatia, providing Bitstore Card services on our behalf.
Platform: The website www.bitstore.net, operated and managed by Digital Assets d.o.o., offers Bitstore Card services to you.
Authentication: Verifying your identity and/or the validity of your payment instruments.
Means of Authentication: Information or methods used to authenticate yourself or authorize transactions, such as a one-time authentication code, CVV code, or PIN.
Authorization: The act of confirming your intent to perform a specific transaction.
Card Data: Information associated with your Bitstore Card, including your name, card number, expiration date, and security codes.
You or Cardholder: A natural person who has been issued a Bitstore Card and is authorized to use it. By clicking the “submit” button on the registration page of Bitstore Card, this Agreement will be binding upon the Cardholder immediately.
Bitstore Card or Card: A Visa debit card issued by Wallester AS in cooperation with Digital Assets d.o.o., which you may use to perform transactions.
Chip&Pin Card: A physical Bitstore Card with an electronic chip requiring a PIN for authorization.
Virtual Card: A digital version of the Bitstore Card comprising Card Data without a physical form.
"Bitstore Card Terms of Use" means this document, which stipulates the rights and obligations of the Partner and/or you in relation to Wallester's provision of Bitstore Card services to you.
Visa: International Card Organization Visa Europe Ltd.
Terminal: An ATM, payment terminal, or any system (including online environments) where you can use your Bitstore Card.
Transaction: Any use of the Bitstore Card to pay for goods and services, withdraw cash, or obtain information.
Strong Authentication: An authentication process involving at least two independent factors from categories such as knowledge (something you know), possession (something you have), or inherence (something you are).
Supported Cryptocurrency: Specific digital assets listed in your account can be used for spending via the Bitstore Card. The types of supported cryptocurrencies may vary by jurisdiction.
Euro and "EUR" refer to the lawful currencies of the Participating Member States introduced inaccordance with the EMU Legislation.
1.2 References to statutes or regulations include any amendments or successors.
1.3 Headings of the terms and conditions of this Agreement are for convenience and do not affect interpretation.
1.4 Terms like "including" imply inclusion without limitation.
1.5 Unless it is agreed otherwise herein, should there be any conflict or inconsistency between the documents hereunder, the validity of the documents shall be prioritized in the following order to resolve such conflict or inconsistency.
a. Bitstore Card Terms of Use
b. User Service Agreement of the Platform
c. Privacy Policy of the Platform
d. Privacy Policy of Wallester’s Website
e. Anti-Money Laundering and Counter-Terrorism Financing Policy
f. Other applicable agreements, rules, or guidelines may be implemented.
1.6 This Agreement may be available in different languages only for your convenience. Should there be any inconsistency or conflict between the different language versions in terms of content, or should there be any omission in one language version, the English version of the Bitstore Card Terms of Use shall prevail.
2. What is the Bitstore Card?
2.1. The Bitstore Card is a Visa debit card issued by Wallester AS, a licensed payment institution and principal member of Visa, authorized to provide payment instrument issuing services within Estonia and other EEA countries under the cross-border license.
2.2. By using the Bitstore Card, you agree to abide by this Agreement and any other applicable terms and conditions.
2.3. You may use your Bitstore Card to purchase goods and services at merchants accepting Visa and to withdraw cash from ATMs that accept Visa cards.
3. Eligibility
3.1. The Bitstore Card is available only to citizens and European Economic Area (EEA) residents who meet the eligibility requirements. You must pass identity verification with a supported EEA-issued identity document to be eligible.
3.2. Eligible countries include Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Iceland, Liechtenstein, and Norway.
3.3. By applying for and using the Bitstore Card, you confirm that you are a resident of a permitted jurisdiction. You must notify us immediately if your residency status changes.
4. How to Apply for a Bitstore Card
4.1. To apply, provide the required personal information on the application page.
4.2. Your information will be shared with our service providers for identity verification purposes in accordance with our Privacy Policy. The purpose of sharing your personal information with our service providers is to verify your identity and address. This is to ensure that the application is legitimate and to prevent fraud. The information shared may also be used to manage risk, as required by applicable laws. This step helps assess the risk associated with issuing a Bitstore Card to you.
4.3. Your application will be rejected if you fail to provide accurate information or are unable to verify your identity.
4.4. We reserve the right to refuse your application at our sole discretion if you violate any terms of this Agreement.
4.5. By applying, you represent and warrant that you:
- Are at least 18 years old.
- Have not been previously suspended or removed from our services or other similar services provided by other parties
- Have full authority to enter into this Agreement.
- Are using the services in your own name and for your own benefit.
- Are not located in, under the jurisdiction of, or a national or resident of any Locations outside the Permitted Jurisdictions.
- Will not use our services in violation of applicable laws.
- Are not designated under any sanctions lists.
- Have read and understood this Agreement.
5. Getting Started
5.1. Use the Bitstore Card only in accordance with this Agreement.
5.2. Upon approval, you may immediately start using your Virtual Card for online purchases.
5.3. Only the Cardholder is authorized to perform transactions with the Bitstore Card.
5.4. You will receive personal Means of Authentication for transaction authorization.
5.5. Physical Cards (Chip&Pin Cards) will be sent to your provided address. Upon receipt, activate your Card via the Platform or the Bitcoin Store Wallet App.
5.6. Sign your physical Bitstore Card immediately upon receipt and activate your Card as soon as possible through either the Platform or the Bitcoin Store Wallet App.
5.7. You may perform transactions within the limits specified in this Agreement and only at terminals displaying the Visa logo.
5.8. Failure to activate your Card within three (3) months may result in automatic closure without refund of service charges.
5.9. Do not use invalid, closed, or unfit Cards. Destroy such Cards within three (3) days of their invalidation.
5.10. Virtual Cards are valid until the last day of the expiration month. A new Virtual Card requires a new application upon expiration.
6. Use of the Bitstore Card
6.1. Transactions require your consent, your consent is deemed to be provided when personal Means of Authentication (e.g. CVV code, and/or PIN code for the Chip&Pin Card) has been correctly provided.
6.2. You are responsible for safeguarding your Means of Authentication. Report any unauthorized transactions or loss/theft of your Card immediately.
6.3. Acceptance of the Card is subject to the discretion of merchants, ATM owners, Card Scheme and/or service providers.
6.4. Usage limits are specified in the Bitstore Card FAQ. We may adjust limits or usage scope as necessary.
6.5. Using the Bitstore Card outside permitted jurisdictions may incur additional fees as specified in the Fee Schedule.
6.6. Transaction details are available through the Bitstore Card portal; monthly statements are not provided.
6.7. You are responsible for the Transactions and related fees and charges even if: i) you do not sign a sales slip (including where a Transaction may be effected by telephone, mail, electronic means, or direct debit arrangement without a sales slip or without your signature) or the signature on the sales slip is different from the signature on your physical Bitstore Card; or ii) the transaction is effected involuntarily; or iii) when the actual transacted amount is higher than the authorized amount. If there are any outstanding fees and charges owed to us, we may impose a penalty, charge interest on the outstanding amount at the prevailing rate, or without prior notice, deduct or set off the outstanding amount from the balance of your account.
6.8. Do not use the Bitstore Card for illegal activities or transactions that violate any laws.
6.9. All transactions made with your Card are considered authorized by you. You shall accept our records of all transactions effected, processed, or conducted through the use of the Bitstore Card as correct and conclusive, save in the case of manifest error, and you agree to be bound by our records.
6.10. Transactions are binding if you have authorized them. By authorizing the Operation, the Cardholder gives its consent to Wallester to perform the Operation. To authorize the Operation, the Cardholder shall enter the Card Data into the field indicated for that purpose on the respective website of the service provider or make a point-of-sale transaction through contactless by scanning a mobile device on the site of the service provider Consent is deemed received when payment data is submitted to Visa.The maximum time for performance of the Operation is 24 hours.
6.11. Service providers may refuse Bitstore Card payments at our request.
6.12. You must present identification upon request when using the Chip&Pin Card.
6.13. Only you may perform transactions with your Bitstore Card.
6.14. When using the Bitstore Card, you are required to use Strong Authentication, except when using the Chip&Pin Card within the limit prescribed for Operations performed with a Near Field Communication device if you agree to the performance of the Operation by touching the Near Field Communication device.
6.15. If you have given your consent to the performance of the Operation, you shall not have the right to be refunded for the Operation unless the person who provided the corresponding service agrees to the refund of the amount paid for the Operation. The consent to perform the Operation or the "payment order" is deemed to be received by Wallester at the moment when payment data is submitted to Visa. The maximum time for the performance of the Operation is 24 hours.
6.16. You accept that all Operations performed by you and/or by using the Means of Authentication of the Bitstore Card or by entering the required particulars in the Internet environment and/or by touching the Near Field Communication device are valid for us and shall be executed by us.
6.17. We have the right to bring in third parties to execute Operations.
6.18. We reserve the right to set transaction limits and minimum/maximum amounts.
6.19. Report any malfunctions or issues preventing transactions immediately.
6.20. The Card is valid until the expiration date indicated on it.
7. Security Requirements
7.1. You must:
7.2 Sign your Card upon receipt.
7.3 Use the Card according to this Agreement and protect it from damage or unauthorized access.
7.4 Not share Card Data or the Card with third parties, except during a transaction.
7.5 Not store Card Data on any medium.
7.6 Not use the Card for illegal purposes and in manner, including the purchase of goods and services that are prohibited by applicable law, which may cause damage to usr and/or to a third party.
7.7 Report errors or disruptions immediately.
7.8 Perform other obligations arising from the Payment Card Terms and Conditions or the legislation.
7.9 If you suspect that a third party has obtained your Card Data or there is a risk of unauthorized use, contact customer service immediately. We will take steps to prevent further use of the Card.
8. Information and Complaints
8.1. Check your transactions regularly. Report unauthorized or incorrect transactions promptly but no later than the period specified by applicable laws.
8.2. For disputes over transaction amounts, contact the merchant directly.
8.3. Any other complaints or disputes should be resolved through negotiation. If unresolved, disputes will be settled in the courts where Wallester has its registered office.
8.4. This Agreement is governed by the laws of the Republic of Estonia unless overridden by mandatory legal provisions.
9. Prevention of Money Laundering and Terrorism Financing
9.1. In preventing money laundering and terrorist financing, we have the rights to:
9.1.1 Regularly verify your identification information.
9.1.2 Request additional documents or information.
9.1.3 To impose temporary or permanent transaction restrictions.
9.1.4 To request documents and information concerning the activities of the Cardholder, including information on the purpose and nature of the transaction, as well as the source and proof of funds and assets.
9.1.5 To request from you documents forming the basis for a transaction, including information or documents concerning the counterparty of the transaction, the beneficial owner, or other persons involved in the transaction.
9.2 We have the right to refuse to execute Operations if you do not comply with the requirements set out in Clause 9.1.
10. Funding Your Bitstore Card
10.1. To use a Bitstore Card, you should have sufficient funds in your Bitstore Card account to make Transactions. The primary source of funds used by Bitstore Card will be the Supported Cryptocurrency in your Bitstore Card Account. The Default Spending Currency will be USDT. ("Default Spending Currency").
10.2. By using Supported Cryptocurrency, you authorize us to convert it to EUR for funding transactions. Please note that the exchange rate is variable, and we shall determine it solely.
10.3. If insufficient funds are available, we may debit other accounts you hold with us to cover the transaction amount.
11. Refunds
11.1. Refunds for transactions made with Supported Cryptocurrency will be credited to your EUR balance in your Bitcoin Store account.
11.2. Refunds are processed in EUR at the original transaction amount. Rewards earned on refunded transactions will be reversed.
11.3. We reserve the right to convert refund amounts into another currency at our discretion.
12. Unauthorized Overdrafts
12.1. If a transaction exceeds your available balance, we may:
12.1.1 Decline the transaction and charge a service fee.
12.1.2 Approve the transaction, creating an overdraft that incurs interest and fees.
13. Card Validity and Renewal
13.1. The Card is valid until the last day of the month indicated.
13.2. We may prepare a new Card upon expiration and will inform you accordingly.
13.3.We have the right not to prepare and/or issue a new Card if you have breached any terms of this Agreement or no longer meet eligibility requirements.
13.4. If you wish to avoid receiving a new Card, notify us in writing at least 45 days before your current Card expires.
13.5. Do not use invalid or closed Cards. Destroy such Cards within three (3) days.
13.6. Virtual Cards require a new application upon expiration.
14. Loss, Theft, or Misuse of the Bitstore Card, PIN, or Mobile Device Report
14.1. Report any loss, theft, or unauthorized use of your Card, PIN, or Means of Authentication immediately.
14.2. You are responsible for all transactions made before we receive your report.
14.3. Notify us of any unauthorized transactions within 60 days. Failure to do so may result in loss of dispute rights.
15. Bitstore Card Reward Program
15.1. We may offer rewards or benefits associated with the Bitstore Card.
15.2. Eligibility for rewards may vary based on factors specified on the Bitstore Card portal.
15.3. Separate applications may be required for certain benefits.
15.4. We are not responsible for merchant goods or services. Disputes must be resolved with the merchant.
15.5. Rewards may not be redeemable if you become insolvent.
15.6. We may modify or terminate the rewards program at any time without prior notice.
15.7. We reserve the right to disqualify you from the rewards program for violations of this Agreement or misuse.
16. Termination, Suspension, and Restrictions
16.1. We may restrict, suspend, or terminate your Card without prior notice if:
16.1.1 Required by law or legal authority.
16.1.2 You violate this Agreement or misuse the Card.
16.1.3 We suspect fraudulent or unauthorized use.
16.1.4 Required for compliance with regulations.
16.1.5 Your account lacks sufficient funds.
16.2. If we restrict, suspend, or terminate your Bitstore Card or Transactions, we endeavor to provide you with notice and the reasons for making such a decision. You may then proceed to correct any mistakes or errors that led to the restriction, suspension, or termination. Once the reasons for the decline, restriction, suspension, or termination cease to exist, we will reinstate the Card Transaction and/or lift any restrictions, suspensions, or terminations as soon as reasonably practicable. However, in certain cases, we may not be able to provide you with notice and/or reasons if it is prohibited by law, our contractual obligations owed to third parties, or in our sole discretion, we deem it appropriate not to disclose the reason.
16.3. The Bitstore Card remains our property and must be returned upon request.
16.4. We may modify or cancel any services, benefits, or privileges associated with your Card.
16.5. We are entitled to refuse to execute the Operation performed by you if:
- The Bitstore Card is invalid, closed, or blocked.
- The Operation amount and/or limit (including the Operation fees and expenses) exceeds the available amount and/or limit stipulated in the Agreement;
- On any other basis arising from the Agreement or the legislation.
16.6. If the reasons for blocking the Card persist, we may close the Card.
16.7. You may request to block or close your Card at any time.
16.8. Do not use blocked, closed, or invalid Cards.
16.9. Unless otherwise provided by the Imperative Norms, we shall not be liable for any damage caused to you or any other third party by Wallester’s blocking the use of the Card or closing the Card in accordance with the Agreement. This shall also be the case if we block the use of the Card in good faith based on incorrect information.
17. Exclusions and Limitations of Liability
17.1. We are not liable for:
- Merchant refusal to accept the Bitstore Card.
- Compliance with laws and regulations.
- Decisions to restrict, suspend, or terminate the Bitstore Card.
- Declined transactions.
- Service disruptions beyond our control that prevent the Operation from being performed.
- Issues with third-party devices or terminals.
- Indirect or consequential losses.
17.2. If your Card is faulty, our liability is limited to assisting with its replacement.
17.3. We may issue a replacement Card at our discretion and may charge a handling fee.
17.4. We are not responsible for disputes with merchants or associated services. Suppose you encounter issues with these goods, services, benefits, discounts, or programs. In that case, you must seek a resolution directly from the relevant merchant.
17.5. We may charge your account for all transactions, even in cases of merchant disputes.
17.6. During the review of a disputed transaction or chargeback involving you and a merchant, we reserve the right to debit your account for the transaction amount. You acknowledge that any chargeback process may result in additional charges, for which you agree to indemnify us. The resolution of the chargeback is not guaranteed, regardless of your indemnity. Failure to provide the required documentation within the specified timeframe to support your claim may lead to the chargeback being denied and the transaction amount being deducted from your account. Should the investigation conclude in your favor, we may refund the relevant amount at our discretion. We hold the sole authority to determine whether a refund will be processed while the investigation is ongoing.
17.7. If an unauthorized payment is made using lost or stolen Card Data or Means of Authentication, or if the Card Data or Means of Authentication are otherwise used unlawfully due to your failure to safeguard them, and no statutory conditions exempt you from liability, we will not bear responsibility for the resulting financial loss. You will be fully liable for any damages incurred until you provide proper notification to us, up to a maximum of €50. This limit does not apply if the unauthorized payment involves fraud on your part or if you have intentionally or through gross negligence violated any of the following obligations:
a. To use the Card Data and/or Means of Authentication in compliance with the terms and conditions of their issuance and use, including taking all reasonable steps to protect them from unauthorized access or misuse from the moment you receive them;
b. To immediately report the loss, theft, or unauthorized or improper use of the Card Data and/or Means of Authentication upon becoming aware of the incident;
c. To adhere to all conditions set forth for the issuance and use of the Card Data and/or the Means of Authentication.
18. Personal Data
You authorize us to disclose your personal data to third parties as necessary to provide services related to your Bitstore Card in accordance with our Privacy Policy.
19. Amendments
19.1 We may unilaterally amend or modify this Agreement at any time by providing you with at least two (2) months’ prior notice, either by posting a notice on the Platform or via other means of communication.
19.2 If you do not agree to any proposed amendments, you have the right to terminate this Agreement with immediate effect and free of charge at any time during the two (2)-month notice period, provided all obligations owed by you under this Agreement have been fulfilled. If you fail to exercise this right before the end of the two (2)–month period, you shall be deemed to have accepted the amendments. Continued use of the Bitstore Card after that period will constitute your acceptance of such amendments.
20. Notices
You agree that we may provide notices, agreements, and announcements through electronic means, such as platform announcements, website messages, emails, SMS, or other wireless communication methods, as well as through physical means, such as postal mail. These notices, agreements, and announcements will be considered delivered to you on the day they are sent. Postal mail will be deemed delivered on the third calendar day following their dispatch to the contact address you have provided on the Platform.
If you do not receive any such notice, Agreement, or announcement due to reasons beyond our control, such as an inaccurate or invalid email address, phone number, or contact address—you agree that the Platform shall not bear any liability in such circumstances.
21. Entry into Force and Termination
21.1. This Agreement is effective upon your acceptance during the Bitstore Card registration process.
21.2. We may terminate this Agreement without prior notice if:
- You provided false information.
- You fail to fulfill payment obligations.
- The Card has been blocked for at least four (4) consecutive months.
- The Card has not been used for six (6) consecutive months.
21.3 In addition to the circumstances outlined in this Agreement, we reserve the right to terminate the Agreement immediately, without prior notice, on any other legal grounds as permitted by applicable laws.
21.4 Termination of the Agreement will not affect our ability to collect or enforce any financial obligations or claims that arose prior to the termination.
21.5 We may also terminate this Agreement by giving you at least two (2) months’ prior notice.
22. Final Provisions
22.1. We may disclose information about transactions and your Card to third parties as permitted by law.
22.2. Personal data processing complies with the EU General Data Protection Regulation (EU) 2016/679 (General Data Protection Regulation), available for reference at https://gdpr-info.eu/
